CHARLESTON COUNTY, S.C. (WCIV) — The attorneys for the former Charleston County Sheriff’s Office (CCSO) deputy facing criminal charges are denying allegations that their client used a racial slur during the incident.
James Henry Carter III is charged with assault and battery in the third degree in connection with his arrest of Rashard Keithan Duncan in October. He turned himself in on Nov. 27 and was released on bond the same day.
According to the South Carolina Law Enforcement Division (SLED), Carter struck Duncan in the face and knocked him unconscious during a pursuit.
On Nov. 29, attorneys Joseph Cannarella and Andy Savage, representing Carter, responded to allegations of the former deputy using a racial slur while he was arresting Duncan. The attorneys denied the allegations and provided a transcription of Carter’s body camera during the incident, which they say was done blindly by a certified transcriptionist without any input.
